Hi,

EE advised that :

If you use any of the below services from your mobile after 28 September 2016, you’ll be charged at the new rates.

Could anyone confirm if this is enough to leave the contract early without paying early termination fee

I think you'll only be able to leave without penalty IF you have previous made use of the services which is increasing in price (e.g out of bundle charges, or calling service numbers).

I don't think this is enough ground to terminate a contract without incurring penalty as this only constitute a price increase notification which is within the provider 's purview!

Future usage is unprovable. The Ofcom regulations say '...*likely* to cause material detriment...'.

Yes but it'll probably only be considered as likely to cause material detriment if you can show you have incurred such charges in the past.

A court would laugh that idea out of the door. There is no way that future usage can be predicted from past usage.
